Terms of Use

The Interested Party Contact Procedure (the "Service") is operated by the Canadian Internet Registration Authority ("CIRA" or "we"). By accessing or using the Service, you signify that you have read, understand and agree to be bound by these Terms of Use. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use the Service. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.

CIRA transfers messages and any attachments (collectively a "Message") without reviewing, screening or vetting the contents. Although we provide rules for user conduct and postings, we do not control and are not responsible for what users transmit through the Service and we assume no responsibility for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content. You assume sole responsibility for your Messages and their contents. You also agree to defend, indemnify and hold CIRA harmless from and against any and all claims, actions, or demands and/or liability arising from or related to your use of the Service.

The Service may be temporarily unavailable from time to time for maintenance or other reasons. CIRA assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or alteration of a Message.

CIRA reserves the right to decline to forward to a Registrant any Message if it comes to CIRA's attention that, or if CIRA reasonably believes that, you have failed to comply with these Terms of Use or any requirements related thereto.

CIRA also reserves the right to prohibit the use of the Service to anyone who fails to comply with these Terms of Use or any requirements related thereto.

You represent and warrant that you will: (i) only use the Service in good faith and solely for a legitimate purpose in connection with a dot-ca domain name for which you need to contact the Registrant who is the holder of the domain name; and (ii) not transmit any materials through the Service which violate or infringe upon the rights of any third party, including any copyright, trademark, privacy, publicity, or other personal or proprietary rights, or contain libelous, defamatory, or otherwise unlawful material. In addition, you agree not to use the Service:

  • in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Service;

  • to upload, post, transmit, share, or otherwise make available any: (a) material that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially offensive; (b) material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (c) unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; or (d) any material which would violate the rights of any party, or that would otherwise create liability or violate any applicable law;

  • to impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;

  • to intimidate or harass another;

You acknowledge and agree that: (a) Messages will be temporarily kept by CIRA solely for the purpose of sending them to your designated recipient, and will be deleted once sent; (b) CIRA will retain the metadata of the messages or sixty (60) days for the purposes of sending the messages and for verification purposes arising from claims of abuse and/or pursuant to the Request for Disclosure of Registrant Information - Rules and Procedures; (c) CIRA limits in the Service the number of requests from a particular IP address and to a particular Registrant; (d) CIRA cannot guarantee that Messages will be delivered, read and/or responded to and that under no circumstances shall CIRA have any liability whatsoever for any failure or inability to deliver a Message by any particular time or at all; and (e) CIRA will not report any response sent to CIRA regarding your Message, or lack thereof.
